Happy 4th of July: SCOTUS Says Burn It

As we come to the nation’s birthday, the Supreme Court has given the country a huge birthday present – the ability of polluters (read corporations) to pollute as they please with little to stop them. Take a deep breath – with a mask on if you’re in a crowd. This may be the last pure breath we receive.

If you missed it, the SCOTUS ruled in West Virginia v. EPA that the EPA (Environmental Protection Agency) does not have the authority to enact environmental regulations. They have the power only to enforce regulations passed by Congress. Environmental science is so vast, so complex, and so complicated that few members of Congress would have the expertise to create regulations. Not to mention that reactionary Republicans would try to block any regulation anyway.

This pretty much neutralizes the EPA and will open the United States to massive pollution. Or at least that’s how I understand it. If you are young, if you have children, if you have grandchildren, the future of all these people becomes very scary.

Defeating Roe is horrible. Neck and neck environmental regulation is existential. This Supreme Court has just ruled on the side of civilizational collapse.

The only way to reverse this decision and all the other appalling decisions by probably the worst court in our history is for congress to act – very, very unlikely – or for congress to set rules for the Supreme Court and increase the number of To research. It’s very unlikely too.

So until we see a move to reign in the Court, I suspect we’re stuck with this awful decision, the awful Dobbs decision, the awful Bruen v. New York on bearing arms. More so, we can expect next year to be even worse. We already know that there will be a case that decides whether a state legislature can overrule the popular vote and vote for voters in the state for whom the legislature decides. Pretty much ends democracy.

Once again, this midterm election has just become the most important in the country’s history. Republicans need to be removed from office and replaced with good Democrats. If we don’t, this may be the last viable election we have in this country.

It really is a scary time.
